Anayasa\u2019s\u0131n\u0131n 50. maddesinde g\u00fcvence alt\u0131na al\u0131nan dinlenme hakk\u0131 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019na tabi olarak \u00e7al\u0131\u015fanlar a\u00e7\u0131s\u0131ndan da \u00f6nem arz etmektedir.<\/p>\n<p>\u0130\u015f yerinde i\u015fe ba\u015flad\u0131\u011f\u0131 g\u00fcnden itibaren, deneme s\u00fcresi de i\u00e7inde olmak \u00fczere, en az bir y\u0131l \u00e7al\u0131\u015fm\u0131\u015f olan i\u015f\u00e7ilere y\u0131ll\u0131k \u00fccretli izin verilir. Bu en az bir y\u0131ll\u0131k s\u00fcrenin ba\u015flang\u0131c\u0131; i\u015f s\u00f6zle\u015fmesinin yap\u0131ld\u0131\u011f\u0131 g\u00fcn de\u011fil, maddede a\u00e7\u0131k\u00e7a belirtildi\u011fi \u00fczere, i\u015f\u00e7inin i\u015fe ba\u015flad\u0131\u011f\u0131 g\u00fcnd\u00fcr.<\/p>\n<p>&#8211; <a href=\"https:\/\/iskanunu.com\/sizin-sorduklariniz\/yillik-izin-nedir\/\" rel=\"nofollow noopener\" target=\"_blank\">iskanunu.com<\/a><\/p><\/blockquote>\n<p>Yukar\u0131daki al\u0131nt\u0131dan anla\u015f\u0131ld\u0131\u011f\u0131 \u00fczere hem\u015fire olarak i\u015fe ba\u015flama tarihiniz baz al\u0131nmaktad\u0131r. Y\u0131lba\u015f\u0131 baz al\u0131nmamaktad\u0131r. \u00d6rne\u011fin 23 Ekim 2020&#8217;de i\u015fe ba\u015flam\u0131\u015fsan\u0131z, resmi kay\u0131tlarda b\u00f6yle ise, y\u0131ll\u0131k izin hakk\u0131n\u0131 23 Ekim 2021 tarihi itibariyle elde edersiniz. 24 Ekim ve sonras\u0131ndaki g\u00fcnler i\u00e7in y\u0131ll\u0131k izin alabilirsiniz.<\/p>\n<p>Bu bir y\u0131ll\u0131k \u00e7al\u0131\u015fma s\u00fcrecinin i\u00e7erisine rapor, \u00fccretli veya \u00fccretsiz izinler dahildir. Yukar\u0131daki \u00f6rnekten hareket edersek; 23 Ekim \u00f6ncesinde 10 g\u00fcnl\u00fck istirahat raporu alm\u0131\u015fsan\u0131z dahi yine 23 Ekim itibariyle y\u0131ll\u0131k izin hakk\u0131 elde edersiniz. Sizin y\u0131ll\u0131k izin s\u00fcrecinizi geciktirmez.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Yillik_Izin_Kac_Gundur\"><\/span>Y\u0131ll\u0131k \u0130zin Ka\u00e7 G\u00fcnd\u00fcr?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Bir y\u0131l \u00e7al\u0131\u015fan hem\u015firelerin y\u0131ll\u0131k izin s\u00fcreleri y\u0131l bazl\u0131 \u00e7al\u0131\u015fma s\u00fcrelerine g\u00f6re farkl\u0131l\u0131k g\u00f6steriyor:<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Kadrolu_4A_Hemsirelerin_Yillik_Izin_Suresi\"><\/span>Kadrolu (4A) Hem\u015firelerin Y\u0131ll\u0131k \u0130zin S\u00fcresi<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>\u00c7al\u0131\u015fma s\u00fcresinde 10 y\u0131la kadar olan hem\u015fireler i\u00e7in 20 g\u00fcn,<\/li>\n<li>10 y\u0131ldan sonras\u0131 i\u00e7in 30 g\u00fcnd\u00fcr.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Sozlesmeli_4B_Hemsirelerin_Yillik_Izin_Suresi\"><\/span>S\u00f6zle\u015fmeli (4B) Hem\u015firelerin Y\u0131ll\u0131k \u0130zin S\u00fcresi<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>Kadrolu (4A) \u00e7al\u0131\u015fanlar ile ayn\u0131d\u0131r.<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Yillik_Izin_Devretmesi_Durumu\"><\/span>Y\u0131ll\u0131k \u0130zin Devretmesi Durumu<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Biz hem\u015fireler e\u011fer elde etti\u011fimiz y\u0131ll\u0131k izin hakk\u0131m\u0131z\u0131 hepsini veya bir k\u0131sm\u0131n\u0131 kullanmazsak, bu izin bir sonraki y\u0131la devreder ancak bu sadece bir \u00f6nceki y\u0131l i\u00e7in ge\u00e7erlidir.<\/p>\n<p>\u00d6rne\u011fin 2020 y\u0131l\u0131ndaki 20 g\u00fcnl\u00fck iznimizin 5 g\u00fcn\u00fcn\u00fc kullanmad\u0131k diyelim. 2021 y\u0131l\u0131nda 20 g\u00fcn art\u0131 5 g\u00fcn olmak \u00fczere toplamda 25 g\u00fcn izin hakk\u0131m\u0131z olacakt\u0131r. Diyelim ki biz bu y\u0131lda izin haklar\u0131m\u0131z\u0131 kullanmad\u0131k. 2021 y\u0131l\u0131ndaki 20 g\u00fcnl\u00fck izin hakk\u0131m\u0131z 2022 y\u0131l\u0131na devredilecektir ancak 2020 y\u0131l\u0131ndaki 5 g\u00fcnl\u00fck izin hakk\u0131 iptal olacakt\u0131r.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Kadrolu_4A_ve_sozlesmeli_4B_arasinda_yillik_izin_devretmesi_farki_var_midir\"><\/span>Kadrolu (4A) ve s\u00f6zle\u015fmeli (4B) aras\u0131nda y\u0131ll\u0131k izin devretmesi fark\u0131 var m\u0131d\u0131r?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>2021 y\u0131l\u0131ndan \u00f6ncesine kadar s\u00f6zle\u015fmeli hem\u015firelerde maalesef y\u0131ll\u0131k izin hakk\u0131 bir sonraki y\u0131la devretmiyordu. 2021 y\u0131l\u0131ndan itibaren al\u0131nan yeni kararla birlikte bu hak s\u00f6zle\u015fmeli \u00e7al\u0131\u015fanlara da tan\u0131nm\u0131\u015f oldu.<\/p>\n<blockquote><p>S\u00f6zle\u015fmeli personelin y\u0131ll\u0131k izinlerine dair d\u00fczenleme &#8220;S\u00f6zle\u015fmeli Personel \u00c7al\u0131\u015ft\u0131r\u0131lmas\u0131na \u0130li\u015fkin Esaslar&#8221;\u0131n 9. maddesinde \u015fu \u015fekilde d\u00fczenlenmi\u015ftir:<\/p>\n<p>&#8220;Madde 9- 217 say\u0131l\u0131 Devlet Personel Ba\u015fkanl\u0131\u011f\u0131 Kurulu\u015f ve G\u00f6revleri Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararnamenin 2 nci maddesinde belirtilen kurumlarda ge\u00e7en hizmet s\u00fcresi, bir y\u0131ldan on y\u0131la kadar olan personele yirmi g\u00fcn, on y\u0131ldan fazla olanlara otuz g\u00fcn \u00fccretli y\u0131ll\u0131k izin verilir. (Ek c\u00fcmleler: RG-6\/2\/2021-31387-C.K.-3507\/2 md.) S\u00f6zle\u015fme d\u00f6neminde kullan\u0131lmayan izinler, s\u00f6zle\u015fmenin devam\u0131 halinde m\u00fcteakip s\u00f6zle\u015fme d\u00f6neminde kullan\u0131labilir. Cari s\u00f6zle\u015fme d\u00f6nemi ile bir \u00f6nceki s\u00f6zle\u015fme d\u00f6nemi hari\u00e7, \u00f6nceki s\u00f6zle\u015fme d\u00f6nemlerine ait kullan\u0131lamayan izin haklar\u0131 d\u00fc\u015fer.&#8221;<\/p>\n<p>6 \u015eubat 2021 tarihinde eklenen c\u00fcmleyle, s\u00f6zle\u015fmeli personele, \u00f6nceki y\u0131l kullanamad\u0131\u011f\u0131 izinleri bir sonraki y\u0131la devretmesi imkan\u0131 getirilmi\u015ftir.<\/p>\n<ul>\n<li><a href=\"https:\/\/www.memurlar.net\/haber\/986269\/sozlesmeli-personelin-yillik-izninin-devri-bir-defalik-miydi.html\" rel=\"nofollow noopener\" target=\"_blank\">Memurlar.net<\/a><\/li>\n<\/ul>\n<\/blockquote>\n<h2><span class=\"ez-toc-section\" id=\"Yillik_Izin_Nasil_Alinir\"><\/span>Y\u0131ll\u0131k \u0130zin Nas\u0131l Al\u0131n\u0131r?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone wp-image-498 size-full\" src=\"https:\/\/furkangunes.com.tr\/blog\/wp-content\/uploads\/2022\/07\/yillik-izin-1-nasil-alinir-scaled-1.jpg\" alt=\"Y\u0131ll\u0131k izin nas\u0131l al\u0131n\u0131r?\" width=\"2560\" height=\"1920\" title=\"\"><\/p>\n<p>Hem\u015fire olarak \u00e7al\u0131\u015fanlar, y\u0131ll\u0131k izin almak i\u00e7in \u00f6ncelikle hastanede \u00e7al\u0131\u015ft\u0131klar\u0131 servisin sorumlu hem\u015firesine en az bir ay \u00f6ncesinden bilgi vermelidir. E\u011fer y\u0131ll\u0131k izin planlama \u00e7izelgesi tutuluyorsa, bu planlamaya mutlaka izin kullanmak istedi\u011finiz g\u00fcnleri belirtmelisiniz.<\/p>\n<p>Ancak diyelim ki 6 ay sonras\u0131 i\u00e7in izin istemi\u015ftiniz ancak 1 ay sonras\u0131 i\u00e7in izin ihtiyac\u0131n\u0131z olu\u015ftu. Durumu servis sorumlu hem\u015firenize bildirdi\u011finiz takdirde gereken d\u00fczenlemeleri yapmak durumundad\u0131r. \u00c7izelgelerde aylar sonras\u0131 planlanan izinler resmi ve kesin izin hakk\u0131 de\u011fildir sadece kurum i\u00e7i i\u015fleyi\u015fin d\u00fczenini devam ettirmek i\u00e7in inisiyatif al\u0131narak yap\u0131lan bir i\u015flemdir. Kesin bir ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 yoktur.<\/p>\n<p>Servis sorumlu hem\u015fireniz ile birlikte planlad\u0131\u011f\u0131n\u0131z izninize iki hafta kala hastanenizin \u00f6zl\u00fck birimine ba\u015fvurarak y\u0131ll\u0131k izin istek formunu bu birimden teslim almal\u0131s\u0131n\u0131z.<\/p>\n<p>Baz\u0131 birimlerde formda izin isteyenin ve sorumlu hem\u015firenin imzas\u0131 yeterli iken baz\u0131lar\u0131nda servis sorumlu doktorunun da imzas\u0131 gerekebiliyor. Bu noktaya dikkat edin.<\/p>\n<p>Formda izne ba\u015flama, i\u015fe ba\u015flama tarihlerini, sizin, servis sorumlu hem\u015firenizin ve gerekiyorsa sorumlu doktorunuzun imzalar\u0131n\u0131 tamamlay\u0131p kontrol ettikten sonra bu belgeyi y\u00f6netim alan\u0131ndaki Sa\u011fl\u0131k Bak\u0131m Hizmetleri M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde ilgili birime teslim etmelisiniz. M\u00fcd\u00fcrl\u00fck bu belgeyi onaylad\u0131ktan itibaren ge\u00e7erlilik kazanacakt\u0131r.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Yillik_Izin_Kullanimi_Sonrasi_Performans_Doner_Sermaye_Odemelerinde_Yapilan_Kesinti\"><\/span>Y\u0131ll\u0131k \u0130zin Kullan\u0131m\u0131 Sonras\u0131 Performans (D\u00f6ner Sermaye) \u00d6demelerinde Yap\u0131lan Kesinti<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Y\u0131ll\u0131k izin kullan\u0131m\u0131 sonras\u0131 maalesef performans \u00f6demelerinde kesinti ya\u015fama durumunuz mevcuttur.<\/p>\n<ul>\n<li>\u0130lk y\u0131ll\u0131k izin kullan\u0131m\u0131nda <strong>5 g\u00fcn<\/strong>,<\/li>\n<li>\u0130kinci y\u0131ll\u0131k izin kullan\u0131m\u0131nda <strong>5 g\u00fcn<\/strong>,<\/li>\n<li>\u00dc\u00e7\u00fcnc\u00fc y\u0131ll\u0131k izin kullan\u0131m\u0131nda <strong>2 g\u00fcnl\u00fck<\/strong> hakk\u0131n\u0131z\u0131 kullan\u0131rsan\u0131z herhangi bir kesinti ile kar\u015f\u0131la\u015fmayacaks\u0131n\u0131z.<\/li>\n<\/ul>\n<p>Yukar\u0131da belirtilen g\u00fcnlerin \u00fcst\u00fcnde al\u0131nan her ekstra bir g\u00fcn i\u00e7in, \u00e7al\u0131\u015fman\u0131z gereken g\u00fcn say\u0131s\u0131ndan bir g\u00fcn d\u00fc\u015f\u00fclerek \u00f6deme alacaks\u0131n\u0131z.<\/p>\n<p><span style=\"text-decoration: underline;\">\u00d6rnekle a\u00e7\u0131klamak gerekirse:<\/span><\/p>\n<p>1000 TL performans \u00f6demesi alman\u0131z gereken ay i\u00e7erisinde, 30 g\u00fcnl\u00fck s\u00fcre\u00e7te toplam 20 g\u00fcn boyunca 08.00 &#8211; 17.00 \u015feklinde \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131z\u0131 d\u00fc\u015f\u00fcn\u00fcn.<\/p>\n<p>\u0130zninizi \u00e7\u0131kard\u0131\u011f\u0131n\u0131zda 10 g\u00fcn boyunca \u00e7al\u0131\u015fm\u0131\u015f olacaks\u0131n\u0131z. Performans\u0131n\u0131z\u0131 da bu 10 g\u00fcne g\u00f6re alacaks\u0131n\u0131z. G\u00fcnl\u00fck 50 TL performans \u00f6demesi alaca\u011f\u0131n\u0131z d\u00fc\u015f\u00fcn\u00fcl\u00fcrse, 10 g\u00fcn \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131z i\u00e7in 500 TL \u00f6deme alacaks\u0131n\u0131z.<\/p>\n<p>Diyelim ki bu \u015fartlarda 6 g\u00fcnl\u00fck y\u0131ll\u0131k izin alm\u0131\u015f olsayd\u0131n\u0131z 14 g\u00fcn \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131zdan dolay\u0131 50&#215;14=700 TL \u00f6deme alacakt\u0131n\u0131z. Ancak 5 g\u00fcnl\u00fck izin alm\u0131\u015f olsayd\u0131n\u0131z, 15 g\u00fcn \u00e7al\u0131\u015fsan\u0131z bile 20 g\u00fcnl\u00fck tam performans \u00f6demenizi alacakt\u0131n\u0131z.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Hafta_Sonu_Dahil_Mi\"><\/span>Hafta Sonu Dahil Mi?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Sa\u011fl\u0131k \u00e7al\u0131\u015fanlar\u0131 i\u00e7in en \u00e7ok merak edilip ele\u015ftirilen husus bu olsa da hafta sonu \u00e7al\u0131\u015f\u0131yorsan\u0131z e\u011fer bu da dahildir.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Fazla_Mesai_Yapilan_Ay_Nasil_Oluyor\"><\/span>Fazla Mesai Yap\u0131lan Ay Nas\u0131l Oluyor?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Fazla mesai \u015feklinde \u00e7al\u0131\u015fm\u0131\u015fsan\u0131z dahi ald\u0131\u011f\u0131n\u0131z izinler fazla mesai ve normal mesai saatlerinin toplam\u0131na orant\u0131l\u0131 olarak performansta kesintiye u\u011frar.<\/p>\n<p><span style=\"text-decoration: underline;\">Yani bir \u00f6rnekle a\u00e7\u0131klamak gerekirse:<\/span><\/p>\n<p>Bir ay i\u00e7erisinde normal mesaiyi tamamlamak i\u00e7in 168 saat \u00e7al\u0131\u015fman\u0131z gerekiyor. Y\u0131ll\u0131k izinleriniz bu saatlerden d\u00fc\u015f\u00fcl\u00fcr. 10 g\u00fcnl\u00fck izin al\u0131rsan\u0131z 10&#215;8=80 saat d\u00fc\u015f\u00fclerek 88 saat \u00e7al\u0131\u015fman\u0131z gerekecektir. Ancak y\u0131ll\u0131k izin d\u0131\u015f\u0131ndaki g\u00fcnlerdeki \u00e7al\u0131\u015fmalarla birlikte ay\u0131 112 saat \u00e7al\u0131\u015farak tamamlarsan\u0131z 24 saatlik fazla mesai \u00fccretinizi ayr\u0131ca alacaks\u0131n\u0131z. Ancak y\u0131ll\u0131k izin kesintisi de 80 saat olacakt\u0131r.<\/p>\n<p>168 saat normal mesai gerektiren bir ayl\u0131k performans \u00fccreti 1000 TL ise, 80 saat izin kulland\u0131\u011f\u0131n\u0131z i\u00e7in d\u00fc\u015f\u00fclerek (saati 5,95 TL&#8217;yi biraz ge\u00e7en bir \u00fccret tutuyor) size 523 TL gibi bir \u00f6deme yap\u0131lacakt\u0131r.<\/p>\n<p>\u00d6zetle performans, normal mesai ile alakal\u0131 bir durumdur. Ek mesailer bunu etkilememektedir.<\/p>\n<p>Yine de yap\u0131lan kesintilerden \u015f\u00fcpheniz varsa, mutlaka ba\u011fl\u0131 oldu\u011funuz mutemetlik birimine ba\u015fvurmal\u0131 ve durumun detaylar\u0131n\u0131 \u00f6\u011frenmelisiniz.<\/p>\n<p>Son olarak, kesintilerde Kadrolu (4A) ve S\u00f6zle\u015fmeli (4B) fark\u0131 yoktur. Her iki \u00e7al\u0131\u015fan\u0131n almas\u0131 gereken performans ne ise onun \u00fczerinden kesinti yap\u0131l\u0131r. Her iki grup farkl\u0131 miktarda performans ald\u0131\u011f\u0131 i\u00e7in kesintiler de bu oranda olacakt\u0131r. Kadrolu \u00e7al\u0131\u015fandan az, s\u00f6zle\u015fmeli \u00e7al\u0131\u015fandan \u00e7ok kesinti yap\u0131lamaz.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Yillik_Izinde_Tatillerin_Durumu\"><\/span>Y\u0131ll\u0131k \u0130zinde Tatillerin Durumu<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Maalesef bu konuda net bir kanun belirlenmemi\u015ftir. Y\u0131ll\u0131k izinler i\u015f g\u00fcnleri \u00fczerinden hesaplanmaktad\u0131r. Cumartesi ve Pazar g\u00fcnleri, dini ve resmi bayramlardaki tatil g\u00fcnleri i\u015f\u00e7ilerde y\u0131ll\u0131k izin g\u00fcnlerinden d\u00fc\u015fmezken memurlarda d\u00fc\u015fmektedir. Yani 10 g\u00fcnl\u00fck bayram izninde \u00e7al\u0131\u015fmak durumundaysan\u0131z ve y\u0131ll\u0131k izin talep ederseniz, izin hakk\u0131n\u0131z bu 10 g\u00fcn i\u00e7in kullan\u0131lm\u0131\u015f olacakt\u0131r. Yani y\u0131ll\u0131k izin hakk\u0131n\u0131zdan gidecektir.<\/p>\n<p>Bu konu ile alakal\u0131 m\u00fclga (kapat\u0131lan) Devlet Personel Ba\u015fkanl\u0131\u011f\u0131&#8217;n\u0131n &#8220;tatil g\u00fcnleri izinden d\u00fc\u015f\u00fclemez&#8221; g\u00f6r\u00fc\u015f\u00fc mevcuttur.
